New legal rights for siblings in care in Scotland

Today legislation was introduced in Scotland to give siblings in care legal rights to maintain their relationships.

Part 13 of the Children (Scotland) Act 2020 and the Looked After Children (Scotland) Amendment Regulations 2021 mean local authorities now have a legal duty to ensure siblings are supported to stay together, where appropriate. Where it is not appropriate for brothers and sisters to live together, steps should be taken to help them stay in regular touch with each other and to nurture their relationships.

State of Scotland's Foster Care report 

The survey, which took place in the summer of 2018, covered key practice and workforce issues such as placement stability, training and support for carers, and status and authority of the workforce. In total, 500 foster carers across Scotland took our survey. The messages are clear: foster carers feel that there is a lack of support, training, respect and remuneration.

Walking Tall

About Walking Tall

The Fostering Network in Scotland received funding from the Big Lottery Fund for a two-year project named Walking Tall. The aim was to consult primary school-aged children on their thoughts about living in foster care. This included both children in foster care and the sons and daughters of foster carers. A children’s participation worker was appointed to co-ordinate the workshops and to work alongside a steering group of volunteers to create an activity book.
